The Offers constituted by the Prospectus in electronic form which can be downloaded by clicking below are available only to persons (not including US persons) receiving the Prospectus:
- in electronic form within Australia; or
- in electronic form together with the Investment Statement within New Zealand.
There is no facility for on-line Applications. Persons who receive a copy of the Prospectus in its electronic form may, during the offer period, obtain a paper copy of the Prospectus (free of charge) by telephoning India Equities Fund Ltd on 1300 795 008.
Applications for Shares may only be made on the Application Form attached to the electronic copy of the Prospectus downloaded from this site (together with the Investment Statement in New Zealand), or an Application Form which was attached to or accompanied a paper copy of the Prospectus obtained from the Company (together with the Investment Statement in New Zealand). The Corporations Act prohibits any person from passing on an Application Form to another person unless it is attached to or accompanied by a hard copy of the Prospectus or the complete and unaltered electronic version of the Prospectus. The Investment Statement must also be provided in New Zealand.
Offers of India Equities Fund Ltd’s shares are made in the Prospectus (or, in New Zealand, the Prospectus together with the Investment Statement). Anyone wishing to acquire India Equities Fund Ltd shares who is eligible to participate in the offer will need to complete an Application Form that will be in or will accompany the Prospectus.
India Equities Fund Ltd will not accept a completed Application Form if it has reason to believe that the Applicant has not received a complete paper copy or electronic copy of the Prospectus (together with the Investment Statement in New Zealand) or if it has reason to believe that the Application Form or electronic copy of the Prospectus (or the Investment Statement in New Zealand) has been altered or tampered with in any way.
While the Company believes that it is extremely unlikely that during the period of the Offer the electronic version of the Prospectus, Application Form or Investment Statement will be tampered with or altered in any way, it cannot give an absolute assurance that this will not occur. Any investor in doubt concerning the validity or integrity of an electronic copy of the Prospectus, Application Form or Investment Statement should immediately request a paper copy directly from India Equities Fund Ltd or a financial adviser.
The offer comprised in the Prospectus is not available to non?Australian and non-New Zealand residents where prohibited by local law. The Prospectus is not available to New Zealand residents unless accompanied by a copy of the Investment Statement.
